Pennsylvania’s highest court has overturned a sex assault conviction against 83-year-old famed sitcom star Bill Cosby on Wednesday. Cosby was promptly set free from state prison and driven home.
The Pennsylvania Supreme Court ruled that the prosecutor who brought the case was bound by his predecessor’s agreement not to charge Cosby – even as there was no evidence that promise was ever put in writing.
Cosby was charged in 2015. At his trial, a judge reportedly at first allowed only one other accuser to testify, but then proceeded to allow five other accusers to testify at a retrial. Cosby’s lawyers had argued on appeal that the use of the five additional accusers was improper.
Cosby has served more than two years of a 3-10 year sentence at a state prison near Philadelphia. Prosecutors did not immediately say if they would appeal or seek to try Cosby for a third time.
